I have been informed by the Nelson District Court Collections unit that as of 2 May 2005 the $80 fee for attachment orders has been waived if it is sought and approved at the time of the Order for Examination. It is a reasonable assumption that this will apply to other courts also.
For the benefit of those of you who have been lucky enough not to be familiar with these proceedings.
An Order for Examination (OE) is the process done post a tribunal to 'Enforce a Debt' This is done in front of a court official.
An attachment order (AO) is the authorising document that can result from the OE and is the process that requires WINZ or the debtors employer to pay the debt to you directly.
Now you only get this AO for free if you have all of the information that you need to do an attachment order with you at the time of the OE. You need the following
If you need to come back to the court at a later time with this information you will have to pay the prescribed $80 fee.
